By agreeing to the above description, this will become a verbal contract between you and Michelle’s Cakes. If you wish to initial the contract and bring it in, you are more than welcome to, and we will provide a copy to you. Otherwise please keep a copy of this for your records.
IF you have a structural issue with a cake we are more than willing to come to you your location or meet you here at our shop to make any repairs time permitting. No refunds will be issues unless we come out or the entire cake is returned to the shop the day of your event for us to make any needed repairs and to see what issues have occurred. Any refunds are on a case by case basis. For tiered or art cakes refunds are only on the layer that was effected not an entire cake. We can usually tell what has happened to make a cake have an issue. Please keep in mind in our many years of experience have seen what happens when cakes are transported on tilted car seats, left in a car too long while you run errands or have been dropped. We want everyone to have a successful event, but refunds are not given out due to the handling and storage of the cake after it has left our shop. If you have any questions on transportation and storage please talk to our staff...we will help you get the cake in your car and give you tips to make transportation and set up a success.
Performance of this agreement is contingent upon the ability of Michelle’s Cakes to complete the Agreement and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our immediate control.
A verbal agreement that all is agreed upon via e-mail will serve as our binding contract. You are more than welcome to print and return this agreement signed if you choose to. But a verbal agreement will work just fine. Please make sure you keep a copy for your records as we do.
- Your initial deposit reserves your event date and is non-refundable. This cannot go towards other cake purchases. If you wish to still do your cake as agreed we will make minor changes and remove artwork and any stands, flowers and delivery charges. This change must be firm at time of cancellation and sent in writing to [email protected]. Cancellations are all final at time of cancellation of said date. Make sure you are ready to book and are confirmed on the event before putting any deposits down. Cake deposits are a $25 and wedding cakes $100.
- We must receive the balance by the due date indicated when you place your order. After the due day the order is void, and deposit will not be refunded.
- The date of your final payment is the final date for any changes of size, style or flavors of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.
- Delivery and setup is set in a one hour time frame. We do not deliver cakes hours before your event unless refrigeration is available.
- Cakes for outside events are recommended to be done in Fondant only we are NOT responsible for any Buttercream cakes in an outside venue from May 1– Nov1.
- We are not responsible for any damage to the cake after it has left our shop. You are responsible for providing an appropriate and secure LEVEL area to transport and at the event. Cakes are heavy and require a sturdy LEVEL table, and optimal room temperature of 74 degrees or below.
- If you or your representative elects to pick up and set up a tiered or intricate art cake, you assume all liability and responsibility for the condition of the cake once it leaves Michelle’s Cakes possession. An SUV or Van is recommended. If you pick up in a car the back seat MUST be level. Delivery of the cake should be directly to your venue. IF you are storing overnight refrigeration is a MUST. We highly recommend delivery of all tiered, detailed and heavy cakes.
- Cake stands not rented from our Bakery are at your own risk. Please make sure they can with stand the weight of your cake. Cakes are very heavy and require a properly constructed stand.
- If flowers are provided by an outside source, we will arrange up to 10 stems free; $1 for each additional stem. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. We prefer to provide the flowers to assure quality.
- If you or your representative elects to use a non-licensed or have Friends/Family cut your cake you assume all liability for the cake. Cakes are to be dis assembled prior to cutting. Do not cut while stacked. Cutting directions are available upon request.
- Location of your cake is Important we are not responsible for any cakes set beside speakers, heat lamps, fans, or other conditions that are not optimal to cakes and buttercream icing. The bakery has the right to refuse any set ups that are not optimal conditions for the cake.
- Once cakes are set up, they are not intended to be moved until served. The Bakery is not responsible for damage caused by others after the cake is set up by the bakery Staff.
- On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you. We also reserve the right to use any Cake photos posted on social media by you, guests or professional photographers.

Refund Policy
Date Hold of $25.00 and Wedding Cake deposits of $100 are non-refundable.
Any monies collected minus the deposit will be refunded in full if the cake order is cancelled within 1 week of the event.
All cakes must be cancelled one week in advance to receive a refund.
Failure to cancel within this time frame ensures that the customer will only receive 50% of the refund.
NO CASH REFUNDS ARE GIVEN.
All sales are final after cake pick up.
If you are unsatisfied with your baked good or if there is something incorrect,
we require that you please return your baked good to us within 24 hours of receiving it.
Or notify us via email within that period.
Any corrections we can usually fix time permitting.
All refunds given will be put on in-store credit to be used at a future date.
*We must receive the baked good back in order for a refund to be received.
If product is over 1/3 consumed there will be an adjustment to refunds.
Refunds will be as in-store Credit.
NO CASH REFUNDS WILL BE GIVEN.
Cancellation Policy
Michelle's Cakes requires a 3 Day notice to cancel a cake, cupcake or dessert order.
Wedding cakes require 60 day prior to delivery date.
A full refund will be given and refunded to the credit card used or put on a gift card for in-store credit.
Minus your initial deposit.
NO CASH REFUNDS WILL BE GIVEN.
Failure to receive a 24 hour notice for cancellation will result in a 25% fee
that will be retained by Michelle's Cakes.
Product that is not picked up at the day and time customer selected, will not be refunded or be put on in-store credit.
